Online Privacy Notice

  1. Introduction.
    1. Web Site Owner. Venture Surplus (“Venture Surplus”) is the owner of this web site (“Venture Surplus Web Site”). Venture Surplus can be contacted by phone at (719) 999-5008, or by e-mail at support@venturesurplus.com.  This online privacy notice discloses Venture Surplus information practices for this Venture Surplus Web Site, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. Note that other Venture Surplus web sites may be governed by privacy notices containing different information practices applicable to those sites.
    1. Web Site Visits. Venture Surplus collects certain information from Venture Surplus Web Site visitors. This includes, but is not limited to, the home server domain name, e-mail address, type of computer and web browser, what pages visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.
    1. Web Site Transactions. At times, Venture Surplus will need personal information regarding a customer or a prospect. For example, to process an order or provide a subscription, Venture Surplus may need to know a customer’s name, mailing address, e-mail address and credit card details. It is Venture Surplus’s intent to inform you before Venture Surplus collects personal information, such as user’s name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Venture Surplus will respect your wishes.
  2. Personal Information That May Be Collected.
    1. Identifying Information. In order to access designated subscriber services and/or restricted areas within the Venture Surplus Web site, Venture Surplus will request a user to provide certain personal identifying information, which may include: name, postal address, e-mail address, screen name, password, telephone number, facsimile number, method of payment, and, if applicable, credit card number. Venture Surplus may request additional information necessary to establish and maintain customer’s account.
      1. If you choose a direct payment gateway to complete your purchase, then PayPal stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
      1. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.  If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
      1. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
    1. Service Quality Monitoring. Some Web site transactions may require a customer to telephone Venture Surplus, or Venture Surplus to call the customer. Venture Surplus will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is Venture Surplus’s practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
    1. Information from Children. Venture Surplus does not collect or maintain information from users actually known to be under the age of 13, and no part of Venture Surplus’s Web sites are structured to attract anyone under the age of 13.
    1. Lost or Stolen Information. If a customer’s password is lost or stolen, the customer should promptly notify Venture Surplus in order to enable Venture Surplus to cancel the lost or stolen information and to update its records with a changed password.
    1. Chat Rooms, Forums and Bulletin Boards. If customer participates in an Venture Surplus chat room, discussion forum, or posts messages to an Venture Surplus bulletin board, customer should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside Venture Surplus, who have access to that chat room, forum or bulletin board. Some individual Venture Surplus chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Also, participant’s expressed opinion is his or her own and should not be considered as reflecting the opinion of Venture Surplus.
    1. Links to Other Web Sites. An Venture Surplus Web site may contain links to other web sites. Venture Surplus is not responsible for the privacy practices or the content of those other Web sites.
  3. Consent.
    1. How do you get my consent?  When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, it is implied that you consent to our collecting your personal information and using it for that specific reason only.  If we ask for your personal information for a secondary reason, like marketing, we will ask you directly for your expressed consent, and/or provide you with an opportunity to say no.
    1. How do I withdraw my consent?  If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time by contacting us at support@venturesurplus.com
  4. Uses Made of the Information.
    1. Limited Uses Identified. Without customer’s prior consent, Venture Surplus will not use your personal identifiable information for any purpose other than that for which it is submitted. Venture Surplus uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and in program record-keeping. Venture Surplus also processes billing and business requests related to Venture Surplus Web Site participation
    1. Marketing Uses. Unless customer marks an “x” on the opt-out option box herein provided, Venture Surplus reserves the right to provide customer with information about Venture Surplus’s Web site, Venture Surplus products and services, and related information in which customer has indicated an interest.
    1. Stored Information Uses. Venture Surplus stores and retains the information entered on the Venture Surplus Web site. This information is used to compile a customer’s purchase history in order to enable Venture Surplus to recommend products, services, or special offers that would be of interest to a customer.
    1. Online Advertising. Some companies that help Venture Surplus deliver interactive on-line advertising, such as banner ads, may collect and use information about Venture Surplus’s customers to help Venture Surplus better understand the types of advertising or promotions that are most appealing to Venture Surplus’s customers. After it is collected the information is aggregated so it is not identifiable to a specific individual. If, however, customer would prefer that these companies not collect such information, please mark an “x” on the opt-out option box herein provided.
  5. Disclosure of the Information.
    1. Agents. Venture Surplus employs or engages other companies and individuals to perform business functions on behalf of Venture Surplus. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
    1. Marketing Analysis by Third Parties. Venture Surplus reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.
    1. Disclosure to Governmental Authorities. Venture Surplus may release personal information to appropriate governmental authorities where release is required by law (for example, a subpoena) or by a regulation, or is requested by a government agency conducting investigations or proceedings.
    1. Violation of Terms of Service.  Venture Surplus may disclose your personal information in the event you violate Venture Surplus’s Terms of Service, but only to the extent necessary to protect Venture Surplus’s interests.
  6. Use of Computer Tracking Technologies.
    1. No Tracking of Personal Information. Venture Surplus’s Web Site(s) are not set up to track, collect or distribute personal information not entered by visitors. Through web site access logs Venture Surplus does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
    1. Use of Cookies. Venture Surplus, or its third party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a Web site can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by Venture Surplus or its third party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some Web sites may not then work properly.
      1. Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at.
      1. We also use PREF, persistent for a very short period, Set by Google and tracks who visits the store and from where.
    1. Use of Web Beacon Technologies. Venture Surplus may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non-identifiable notice of that visit is generated which may be processed by Venture Surplus or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer’s visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
    1. Collection of Non-Identifiable Information. Venture Surplus may collect non-identifiable information from user visits to the Venture Surplus Web site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Venture Surplus Web site(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Venture Surplus or its contractors may use this data to analyze trends and statistics.
    1. Collection of Personal Information. Venture Surplus collects personal identifying information from customer during a transaction. Venture Surplus may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Venture Surplus understand trends and patterns. This information is not reviewed at an individual level.
  7. Information Security.
    1. Storage of Data.  Our store is hosted on a dedicated, mega-secure server.  We share it with no one. 
    1. Commitment to Online Security. Venture Surplus intends to protect customer personal information and to maintain its quality. To achieve information security and quality, Venture Surplus implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information.
    1. No Liability for Acts of Third Parties.
      1. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.  However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
      1. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.  In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.  As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. 
      1. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
  8. Privacy Policy Changes and Opt-Out Rights.
    1. Changes to Privacy Policy. This privacy notice was last updated on December 16, 2020. Venture Surplus reserves the right to update its privacy policy statement at any time. A notice of any material change will be posted on the Venture Surplus Web site home page for thirty (30) days prior to the implementation of such change. There are two boxes at the end of Venture Surplus’s notice of change: (1) an “I accept” box, and (2) an “I do not accept” box. If customer does not mark the “I do not accept” box, customer will be deemed to have accepted Venture Surplus’s privacy policy updates.
    1. Opt-Out Right. Customer and prospective customer has the right at any time to cease permitting personal information to be collected, used or disclosed by Venture Surplus and/or by any third parties with whom Venture Surplus has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Venture Surplus via e-mail at support@venturesurplus.com, telephone or postal mail. After processing the cancellation, Venture Surplus will delete customer or prospective customer’s personal information from its data base.
  9. Access Rights to Data.
    1. Information Maintained by Venture Surplus. Upon customer’s request, Venture Surplus will provide a reasonable description of customer’s personally identifiable information that Venture Surplus maintains in its data bank. Venture Surplus can be contacted by e-mail at support@venturesurplus.com.
    1. Corrections and Changes to Personal Information. Help Venture Surplus to keep customer personal information accurate. If customer’s personal information changes, or if customer notes an error upon review of customer information that Venture Surplus has on file, please promptly e-mail Venture Surplus at support@venturesurplus.com  and provide the new or correct information.
    1. Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Venture Surplus who are California residents to request certain information regarding Venture Surplus’ disclosure of personal information for their direct marketing purposes. To make such a request, please write to: support@venturesurplus.com. Within 30 days of receiving such a request, Venture Surplus will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Venture Surplus reserves its right not to respond to requests submitted other than to the address specified in this paragraph.

California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

    1. Terms of Use. If customer chooses to subscribe to Venture Surplus’s services, customer’s action is hereby deemed acceptance of Venture Surplus practices described in this policy statement. Any dispute over privacy between customer and Venture Surplus is subject to the provisions of this notice and to Venture Surplus’s Terms of Use Agreement which is hereby incorporated herein and which can be read at https://www.venturesurplus.com/terms-of-service/.
